Twenty-five year old Marvin Albert of Paradise, Grenada, received two prison sentences at the Serious Offences Court on Wednesday, in connection with a major marijuana haul at the waterfront area in Ashton, Union Island around 10:30 pm,  on January 14, 2022.

Albert was sentenced to one year and one month for possession of 222 pounds of marijuana with intent. He was also jailed for one year and three months for possession of 222 pounds of marijuana for the purpose of drug trafficking. The sentences will run concurrently.

The accused, who pleaded guilty to both charges, received the sentences on Wednesday following a sterling mitigation plea the previous day at the Serious Offences Court, by his lawyer Roderick Jones.  (See related story on this page)

Chief Magistrate Rechanne Browne had adjourned sentencing to Wednesday.

In arriving at the penalties, the Magistrate in following the sentencing guidelines, outlined her starting point as 35 percent of the maximum penalty. Marijuana possession carries a maximum penalty of seven years imprisonment, in the Magistrate’s Court. She then weighed the aggravating and mitigating factors and did the calculations.

The Magistrate highlighted that it was a significant amount of marijuana, but noted that there was no sophisticated level of concealment, others were not exposed to the drug, and no weapon was involved.

In relation to the defendant, she cited his youthfulness; that he had dependent siblings and he had no previous convictions before the court. The Magistrate concluded that in relation to the offence, as well as the defendant, the mitigating factors outweighed the aggravating ones.

Albert also earned a one third discount on his sentence for pleading guilty at the first instance.

He was also sentenced to three months each on two charges of illegal entry, but those sentences will run concurrently to the sentences he received for marijuana possession and trafficking.

Albert was found in possession of the marijuana during a police action at the waterfront area in Ashton, Union Island around 10:30 pm on January 14, 2022.
